Please read these terms and conditions carefully before you buy any books or other products directly from our website. In particular please pay attention to the terms about your rights to cancel the contract (paragraphs 8, 9 and10) and the limits on what we are responsible for (paragraph 12). Unless these Terms specifically say otherwise, they all apply to you whether you are buying as a business or as a consumer. Please also note the different addresses to contact us or to return Books.

We are unfortunately not able to be contacted by telephone. In these Terms we refer to ourselves as us, we, and our.
3. Important Information about the Contract
By Ordering Books you are agreeing to be bound by these Terms. They will apply to the Contract and so if you don't want to accept these Terms then you will not be able to buy the Books from this Website. As part of the Order process you will be asked to confirm you have read and accept these Terms. You should keep a copy of these Terms for your reference. These Terms are occasionally updated so we recommend you read these Terms each time you place an Order.
These Terms form the whole of the Contract between us. you are promising you have not entered into the Contract, relying on any statement, promise or representation made by us or any other person and you waive any rights, in such a way as you cannot go back on this, to claim compensation or to resind the Contract (that means to treat the Contract as though it wasn't entered into), on the basis that there was any misrepresentation (other than if that misrepresentation was fraudulent) that is not contained in these Terms.

We operate the Website. The use of this Website is also subject to the Website Terms of Use which can be found here.
Our Website is only intended for use by people who live in the UK and by people who are over the age of 18 and able to enter into a legally binding Contract.
A Book's true colour may not exactly match that shown on your device and any packaging may be slightly different. We may make changes to the Website and alter, suspend or discontinue any of the Books, how they are described on the Website or the basis on which we sell the Books. We may do this in order to comply with legal requirements or to reflect technical specifications.
5. Placing an Order
By placing an Order to buy Books on the Website you are making an offer to buy the Books you have selected. If we accept your Order we will confirm this by email to the email address you have provided to us in the Order. It is at that point that we have a Contract.
Sometimes we don't accept Orders. This may be because the Book is unexpectedly out of stock, because you are not located in the UK or because the Book has been mispriced on the Website. If we cancel your Order or any part of it we will notify you by email to the email address you have provided to us in the Order and we would also refund any money you have already paid.
6. Price and Payment
Details of the price of the Books is shown on the Website. These prices may be subject to change from time to time. The price you have to pay is the price in place at the date of your Order. You also have the pay the costs of delivery. We are not registered for VAT because we do not at present meet the criteria for this. We therefore do not charge VAT on or as part of the price. If this changes then we will adjust the rate of VAT you will have to pay and our prices would be inclusive of VAT.
You have to pay in full for the your Order when you submit it via the Website and payment will be collected at that time. We use Square to collect payments. You can pay using a credit or debit card. You promise to us that credit or debit card you use is your own and you have sufficient money or bank facilities to cover the payment.
7. Delivery
We will deliver your Books using either Royal Mail 2nd class post or other delivery partner of our choice. We are only a small business so we cannot guarantee a delivery date. Although we do try and get your Order to you within 10 Working Days, any delivery dates given are only an estimate. We do not accept any liability if we are not able to deliver your Order by any estimated delivery date given.
If for any reason your Order does not arrive within 30 days of the date you placed your Order please let us know by email at penfoldandmossop@outlook.com and we will make reasonable efforts to replace them. If you do not contact us within that specified time scale then we may not be able to assist you with a refund or replacement of your Order.
If you don't allow us to deliver your Order within a reasonable time, then we will treat your Order as cancelled and refund the money you have paid for that Order (less any costs we may have reasonably incurred - this may include delivery charges for the attempted delivery).
If we are delayed by events that are outside of our control, then we will email you at the email address you provided in your Order to let you know. We will try and do what we can to reduce the delay and as long as we do that we won't compensate you for the delay. However, if the delay is likely to be substantial, then you can contact us to cancel the Contract by emailing penfoldandmossop@outlook.com and we will issue a refund for the Books you have paid for but not received.
We can choose to deliver your Order in instalments.
8. Your Rights as a Consumer
If you are buying the Books as a consumer (that means not for the purposes of your business, trade or profession) then you may change your mind and cancel your Order at any time within 14 days, beginning on the day after you receive all the Books set out in your Order. You need to notify us in writing that you want to cancel your Order. You can do this by email to penfoldandmossop@outlook.com or by post to Unit 149140, PO Box 7169 Poole BH15 9EL. We don't require you to follow any specific format but you do need to tell us your name, address and Order number. You will have to return the Books to us in the same condition that they were sent to you and you are responsible for them until they reach us. The address to return the Books to is Unit 149140, Courier Point, 13 Freeland Park, Wareham Road, Poole, Dorset BH16 6FH. You are also responsible for paying the postage cost of the return. They have to be returned within 14 days of the date that you cancelled the Order.
Once we have received all of the Books for which you have cancelled the Order, we will refund the price you paid within 14 days of the date we received them, provided all of the conditions set out above, are met.
We do not offer a refund or replacement if you cancel the Order after the 14 day period set out above.
Your statutory rights are not affected.
9. Your Rights as a Business
If you are buying the Books in the course of your business, trade or profession, then we do not offer the right to cancel the Contract because you have changed your mind.
10. Other Returns and Refunds
If the Books are damaged or faulty when they arrive with you, at our discretion we will offer a replacement or a refund. You need to let us know in writing within 14 days of the Books having been delivered either by email to penfoldandmossop@outlook.com or by post to Unit 149140, PO Box 7169, Poole BH15 9EL. We may ask you to return the damaged or faulty Books, before we decide which option is best. We will refund the cost of your returning the Books by Royal Mail second class post tracked, if we find the Books to be faulty or damaged. If we find they are not faulty or damaged then we may return them to you and charge you the cost of delivery.
If for any reason we issue you with a refund it will be within 14 days of receiving return of the Books.
All refunds issued under these Terms will be using the same method as you used to pay for the Books
In all cases Books must be returned to the following address - Unit 149140, Courier Point, 13 Freeland Park, Wareham Road, Poole Dorset, BH16 6FH. Please do not send any other correspondence to this address as it will not be received.
If you are buying as a consumer your statutory rights are not affected.
11. Your Responsibilities
You are responsible for the security and use of any password or login identifier issued to you or created by you in connection with the use of this Website and/or purchase of the Books. You must take reasonable steps to ensure that such identifiers are kept confidential and secure and that you do not allow any other person without your authority to use them.
You are promising that the information you provide to us when you place an Order is true, accurate and not misleading.
12. What we are Responsible For
How we deal with your personal data is set out in our Privacy Notice - please note this may change from time to time. The Privacy Notice does not form part of the Contract between us but you can find a copy here.
We use reasonable efforts to ensure that the Books are of satisfactory quality, will meet the descriptions set out in this Website and will be reasonably fit for their purpose.
Where you are buying the Books as a consumer we are responsible for the losses you suffer caused by us breaking the Contract unless the loss is unexpected, this means that it was not obvious that it would happen and nothing you said to us before we accepted your Order meant that we should have expected it; or unless it was caused by a delay or an event outside of our control; or unless the loss was avoidable, this means where the loss could have been avoided by you taking reasonable actions; or it is a business loss.
Where you are buying the Books in the course of your business, trade or profession then we will, subject to the financial and type of loss limits set out below, be responsible for losses directly arising as a result of our breach of Contract. We otherwise exclude all liability for all types of loss under any type of law including but not limited to negligence, and we specifically exclude liability for loss of profit, loss of reputation or damage to good will, loss of contracts or anticipated savings and indirect or consequential losses. The maximum amount we may be liable for is limited to the value of the Order in relation to which the breach of Contract occurred.
The above restrictions on our liability do not limit our liability for death or personal injury that is as a result of our negligence, fraud or fraudulent misrepresentation, or any other losses that it would be unlawful for us to exclude.

Please note the address for returning Books is different to the address above. The address that should be used for returning books is Unit 149140, Courier Point, 13 Freeland Park, Wareham Road, Poole Dorset, BH16 6FH. Please do not send any other correspondence to the returns address as it will not be received.
Where we have to contact you about these Terms or your Order we will write to you either by email or by post, in either case to the email address or postal address given to us by you in your Order.
If a communication is sent by email then, provided it was properly addressed, it will be deemed received when it is received by the recipient, and if it is sent by post then it will be deemed received two Working Days after the date it was posted.
14. Other Important Terms
We can transfer the Contract to another organisation, but you are not permitted to transfer the Contract to anyone else. We will let you know if we are going to do this.
If a court found that some of these Terms are unlawful or not valid, then those terms would be deleted, but the rest of these Terms would still apply.
If we choose not to enforce our rights on one occasion that does not mean we have waived our rights (any waiver of our rights has to say specifically that we are waiving our rights, be in writing and be signed by us) and it does not mean that we have to take that same course of action in the future.
The Contract is between you and us. No one else can enforce the Contract and no one else has any say if you and we decide to end it or change it.
Any changes to the Contract are only valid if they are in writing and signed by both you and us. An email exchange is enough for this purpose.
The Contract is governed by English law. Wherever you live, you can only enforce the Contract in the English Courts except if you are buying the Books as a consumer. In those circumstances, if you live in Wales, Scotland or Northern Ireland you can also enforce this Contract in the country you live. We can enforce this Contract in the country in which you live.
